The point is that the question of proof can only be posed when an election has taken place in a general and inviolable situation and this election where a level of violability and proof is in place. Then that is when one can discuss the proof of violations. But if some action occurs that is not based within a legal framework and is fundamentally null and void, the talk of proof is irrelevant.

Mr. Kadkhodaei and members of the Guardian Council, violations have taken place in this election, having rendered it’s substance meaningless; and simply it did not have the same meaning and definition of elections.

The first violation has occurred at the hands of the Guardian Council and the culprit who was the supervisor is the personage of the spokesman of the Guardian Council, Mr. Kadkhodaei (Kadkhodaei’s photo is flashed, picture in picture on the screen next to Mohtashamipour). You Sir, have come and within a formal and ordered action, you have posed a question and provided an answer where those both posing the question and responding are the observer members of the Guardian Council.

Within this question and response, issues have been put forth. First, you have asked if the representative member of the city council, where we have city councils, needs to have the confirmation of the Guardian Council or not. Then you responded by saying yes, and that that individual must have the qualification confirmation from the Guardian Council. This is a contradiction to the letter of the law. The law states that several people are automatically members of the board of executors; one is a member of the records and registration bureau, another is a prosecutor of that specific election area and one is a member of the city council, chosen by the city council. In the same way that the Guardian Council does not have the right to confirm the qualifications of the prosecutor, or confirm the qualifications of the director of the bureau of records and registration, it does not have the right to come and say that it needs to confirm the qualifications of the city council member. Are the city council members your representatives for you to confirm them? The law states that the board of executors must be comprised of those who are trusted members of a district and these other individuals. Not only does that person not require your confirmation, the city council members of trusted individuals who the people vote for. Who do you think you are to confirm or disqualify people who are trusted by and voted for by the people? You have no right to do any such thing.

And then, do you know what the philosophy (he means theory but he uses the word philosophy) behind you saying that you need to confirm the qualifications of the members of the city council, is? The philosophy is something that I can tell you after the lack of ‘invitation’ of the representatives of the candidates, Mr. Guardian Council and Mr. Kadkhodaei.

The second issue that has surfaced within this question and answer is: should the governor invite the representatives of the candidates, and should they be present? You’ve answered, no; only on the day of the elections can the representatives be invited. While according to the law and the operative regulations for the election of the president which has been ratified by the government, from the 1st of Khordaad, the representatives of the candidates should have been invited to participate in the board of executors. Why did you refuse? And the Ministry of the Interior has sent out your letter as a memo throughout the country and you did not invite our representatives.

The reason and philosophy behind it is, I tell you Mr. Kadkhodaei, behind this decision-making curtain, laid an extensive violation against the vote of the people. Never, during the various periods of the past 30 years that when the governors offices and the Ministry of the Interior puts forth trusted individuals, that the Guardian Council just wholly accepts them; there has always been some kind of strife. They disqualified the trusted members who were put forth by governors. How come this year, you did not disqualify a single person? And you totally accepted all of them? Because the unilateral Ministry of the Interior, a unilateral group of the ‘trusted’ and a unilateral Guardian Council, supported one candidate. If the representatives of the candidates were able to come an participate, you would never have been able to violate the law. You could not make decisions that would drag the fate of the elections into this situation, so that people would protest against you in such a manner. Your fiber would have changed; that unilateralism would have been destroyed...the people’s aware eyes would have found it’s way to scrutinizing the board of executors. And then, why did you say that you have to confirm the qualification of the city council? Because you feared that this city council member would not jive with that fiber that you have woven. And that someone would have gone against your leanings and decisions in the board of executors, reporting the issues behind the curtain to the people. And as such, you wanted to chose and install the member of the city council from within yourselves. Till things get to this point today.

This is one of your biggest violations and this is rooted in the extensive fraud in this election.

Then the footage of Kadkhodaei, being interviewed by IRIB cuts in where he is saying: It’s finished and the case file with the confirmation of the Guardian council has been completed and closed; and there is no other source to investigate this issue.
